Video Surveillance and Number Plate Recognition Privacy Notice

At Parkhaus Platzhirsch, we use video cameras in designated areas and automatic number plate recognition at the entrances and exits. This notice explains, in accordance with Article 13 of the General Data Protection Regulation (GDPR), which personal data we process, for what purposes and for how long. 3. Video Surveillance

Areas Under Video Surveillance

Video surveillance is carried out exclusively in the following areas, which are identified by appropriate signs:

Entrances and exits
Payment machines and payment area
Areas in front of the lifts on all levels (outside views of the lifts; the interiors of lift cars are not monitored)
Waiting area for shuttle passengers on the ground floor
Loading and unloading zone on the ground floor
Self-service area with snack vending machines on the ground floor
Server room anteroom
Maintenance staff area in the basement
Service Center; the actual computer workstation is excluded from the camera's field of view

Toilets, break rooms, changing rooms and the interiors of lift cars are not subject to video surveillance. No audio is recorded.

Purposes

Protection against theft, burglary and vandalism involving vehicles, machines, facilities and the building
Protection of our customers and employees against assaults
Preservation of evidence in the event of damage, accidents and criminal offences

Legal Basis and Legitimate Interests

The legal basis is Article 6(1)(f) GDPR. Our legitimate interests are to protect people, vehicles and property and to investigate incidents and preserve evidence.

Before introducing video surveillance, we assessed whether less intrusive measures, such as access controls, lighting or patrols, would be sufficient. We use cameras only where necessary for the purposes stated and limit their fields of view to what is required.

Live Monitoring

Camera images may be viewed in real time by our staff on site so that they can respond quickly to hazards, emergencies or disruptions.

Retention Period

Recordings are retained for 7 days and are then automatically overwritten. This period is necessary because many of our customers park their vehicles for several days and often do not notice or report damage until they return. Furthermore, reviewing recordings every day, for example on weekends and public holidays, is not always possible.

If a specific incident occurs, we retain the relevant footage for longer, until the incident has been resolved or legal claims have been conclusively asserted or defended. The footage is then deleted.

4. Number Plate Recognition at Entrances and Exits

How Vehicle Access Works

Parkhaus Platzhirsch may only be used with an advance booking; parking tickets are not issued. When booking online or at our Service Center, you provide your vehicle's registration number. Long-term parkers and corporate customers also register their vehicle registration numbers with us.

At the entrance and exit, a camera captures your vehicle's number plate. Our parking system compares it with the bookings stored on a local server at the car park and opens the barrier if valid authorisation is found.

Purposes and Legal Bases

Vehicle access and billing for booked parking spaces, long-term parkers and corporate customers: performance of the parking contract, Article 6(1)(b) GDPR
Access control for vehicles without a booking: legitimate interest in protecting the car park against unauthorised use, Article 6(1)(f) GDPR

Retention Period

Camera images at entrances and exits: 7 days, followed by automatic overwriting (as described in Section 3)
Registration numbers stored with bookings: until the end of the booking
Afterwards, the registration number is retained only in invoice records for as long as statutory retention obligations require (currently 8 years for invoices as accounting records under Section 147 of the German Fiscal Code (AO) and Section 257 of the German Commercial Code (HGB))

Registration numbers of vehicles without a booking are not stored permanently; they are only included in camera footage, which is overwritten after 7 days.

5. Recipients and Service Providers

Only authorised employees of Platzhirsch (Parking) GmbH have access to the recordings and registration number data.

In the event of a specific incident, and only where there is a legal basis, we may disclose recordings to:

The police and law enforcement authorities
Insurers, including our own and those of the parties involved
Lawyers and courts
Persons who have suffered damage and parties involved in accidents, insofar as they need the footage to enforce their legal claims and the overriding interests of other persons shown in the footage do not prevent disclosure

The installation and maintenance of our video surveillance system are carried out by an appointed specialist company. It accesses the system only at our request and only to the extent necessary for maintenance or troubleshooting. We have concluded a data processing agreement with this provider in accordance with Article 28 GDPR.

Transfers to Third Countries

No data is transferred to countries outside the European Union (EU) or the European Economic Area (EEA).

6. Your Rights

You have the following rights in relation to your personal data:

Access to the personal data processed (Article 15 GDPR)
Rectification of inaccurate data (Article 16 GDPR)
Erasure, where the statutory requirements are met (Article 17 GDPR)
Restriction of processing (Article 18 GDPR)
Data portability for data we process to fulfil a contract, such as the registration number in your booking (Article 20 GDPR)

Right to object (Article 21 GDPR): Where we process data on the basis of Article 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation. We will then cease processing the data unless we demonstrate compelling legitimate grounds that override your interests or the processing is necessary for the establishment, exercise or defence of legal claims.

When requesting access to video recordings, providing the date, time and location helps us find the relevant footage within the retention period. Please contact datenschutz@parkhausplatzhirsch.de.

Right to Lodge a Complaint with the Supervisory Authority

You may lodge a complaint with a data protection supervisory authority (Article 77 GDPR). The authority responsible for us is:
